WILMINGTON - United States Attorney George E.B. Holding announced that in federal court here today Senior United States District Judge James C. Fox sentenced JOSEPH CHARLES FALCO, 35, of Collegeville, Pennsylvania, to 60 months’ imprisonment followed by three years supervised release. The Court also imposed a fine of $150,000.

A Federal Grand Jury returned a Criminal Indictment on February 6, 2008. On July 24, 2008, a jury convicted FALCO of conspiring to transport stolen goods in interstate commerce. From November, 2006, to June, 2007, members of the organization stole over-the-counter medications and health and beauty aids products from retail chains in the Durham, Franklin and Wake County areas. After the products were stolen, co-conspirators “cleaned” the merchandise, removing all stickers and/or security sensors from the packaging. The stolen products were then sold to “fences” and the money laundered through a co-conspirator’s business. Starting in January, 2007, FALCO sold the stolen products through his Internet store, Joe’s World of Health. He purchased products an average of every 12 days until May 24, 2007, at an estimated total loss of $1,032,768 to the merchants.

The investigation showed that FALCO used rental vehicles to travel to North Carolina and transport the stolen products to Pennsylvania.

Mr. Holding commented: “This scheme reveals the ease with which individuals can steal and then peddle the merchandise they have stolen. I commend the agents of the FBI and officers with the Durham County Sheriff’s Department. Their efforts have dismantled this organization and stopped the theft that was plaguing our business community.”

Investigation of the case was conducted by the Federal Bureau of Investigation, and the Durham County Sheriff’s Department. Assistant United States Attorney Thomas Murphy served as prosecutor for the government.
