jury convicts wake county robber on 16 counts

RALEIGH - United States Attorney Thomas G. Walker announced that in federal court Friday, November 16, 2012, ANTONIO RASHAAD DOVINE, 24, was convicted of charges relating to the robberies of businesses in Raleigh, North Carolina.  Following the four-day trial, a jury found DOVINE guilty of all 16 counts charged in the May 15, 2012, Superseding Indictment. Those charges include one count of conspiring to rob a business engaged in interstate commerce, in violation of Title 18, United States Code, Section 1951(b); six counts of robbing a business engaged in interstate commerce, in violation of Title 18, United States Code, Section 1951; six counts of possessing a firearm in furtherance of a crime of violence, in violation of Title 18, United States Code, Setion 924(c)(1)(A)(1), and 3 counts of possession of a firearm by felon, in violation of Title 18, United States Code, Setion 922(g).  United States District Judge Louise Flanagan, presided over the trial. 

     According to evidence presented at trial, DOVINE, along with co-conspirators, Erica McClarin, Micheal Pryor, and Jesse Vickers, robbed businesses over a one month period, from April 2011 to May 3, 2011.  The method used to rob each store was the same; the defendants entered the business wearing bandanas over their faces, and wearing hooded sweatshirts and gloves.  At each robbery one of the defendants would point a shotgun at the business employee, demanding money, while the others would seize the cash drawer from the register and/or cash from the store safe.  The robbers would then flee in a car driven by a co-conspirator who acted as a look-out during the robbery. 

Specific evidence presented revealed that on April 14, 2011, DOVINE, and his coconspirators robbed the Exxon gas station located at 1200 New Bern Avenue, Raleigh, North Carolina.  They stole $5,108.00 from the register and 22 cartoons of cigarettes.

On April 14, 2011, DOVINE and his coconspirators robbed the McDonalds restaurant located at 5016 Spring Forest Road, Raleigh, North Carolina.  They stole $479.00 from the safe.

On April 22, 2011, DOVINE and his coconspirators robbed the Hampton Inn located at 1001 Wake Towne Road, Raleigh, North Carolina.  They stole $357.00 from the register.

On or about April 22, 2011,  DOVINE and his coconcpirators robbed the Courtyard Marriott hotel located at 3908 Arrow Drive, Raleigh, North Carolina.  They stole $350.00 from the register.

On or about April 27, 2011, DOVINE and his conconspirators robbed the Wingate Inn located at 2610 Westinghouse Boulevard, Raleigh, North Carolina.  They stole $300 from the register. During the robbery, a brief struggle between the clerk and defendant resulted in the defendant striking the clerk in the head with the butt of the shotgun.

On or about May 3, 2011,  DOVINE and another coconspirator, attempted to rob the BP gas station located at 2120 New Bern Avenue, Raleigh, North Carolina.  They fled before stealing any money.

At sentencing, set for February 19, 2013, DOVINE faces up to 20 years imprisonment for the conspiracy charge, up to 20 years imprisonment for each of the robbery charges, up to 10 years imprisonment for each of the possession of firearm by felon charges, and up to life imprisonment, consecutive to any other sentence imposed, for each of the use of a firearm during a robbery charges.

Each of the other defendants have pled guilty and are awaiting sentencing.

This case was part of the Project Safe Neighborhoods (PSN) initiative which encourages federal, state, and local agencies to cooperate in a unified “team effort” against gun crime, targeting repeat offenders who continually plague their communities.

Investigation of this case was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives; the Raleigh Police Department; the Wake County Sheriff’s Office.  Assistant United States Attorneys Ethan Ontjes and Leslie Cooley prosecuted the case.
