ATTORNEY GENERAL DECIDES DEATH PENALTY QUESTION
GREENSBORO, NC – Anna Mills Wagoner, United States Attorney for the Middle District of North Carolina, announced today that United States Attorney General Michael B. Mukasey has authorized and directed that the death penalty be sought in the case against Demario James ATWATER.
ATWATER was indicted on October 27, 2008 on carjacking and firearms charges in connection with the March 5, 2008 death of UNC-Chapel Hill Student Body President Eve Marie Carson. The charges are only allegations and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
The office has no further comment on the case at this time.
