
Tokio Man Sentenced for Child Abuse and Neglect
GRAND FORKS - U.S. Attorney Timothy Q. Purdon announced that on
Aug. 27, 2012, Allen H. Demarce, Sr. of Tokio, N.D., was sentenced before
U.S. District Judge Ralph R. Erickson on a charge of child abuse and neglect in Indian
Country.
Judge Erickson sentenced Demarce, Sr. to six months’ imprisonment to be
followed by three years of supervised release. Demarce, Sr. must serve the first six
months of supervision at a residential recovery and re-entry center. Demarce, Sr. was
ordered to pay restitution in the amount of $756 and to pay a $100 special assessment to
the Crime Victim's Fund.
Demarce, Sr., 29, pleaded guilty on June 1, 2012, to assaulting a two-year-old child
by striking him with an open hand resulting in bodily injury to the child’s face, arms, and
back. The incident occurred in March of 2011 on the Spirit Lake Indian Reservation.
The case was investigated by the Federal Bureau of Investigation.
Assistant U.S. Attorney Janice M. Morley prosecuted the case.
