Macy Woman Sentenced for Assault Resulting in Serious Bodily Injuries

United States Attorney Deborah R. Gilg announced that Nicole Payer, 32, of Macy, Nebraska., was sentenced on November 28, 2011, to 37 months in prison by United States District Judge Laurie Smith Camp, for her conviction of assault resulting in serious bodily injuries. In addition to her prison term, Payer will serve three years of supervised release following her release from prison. Payer was further ordered to pay restitution in the amount of $53,109.96

On November 29, 2010, Payer was driving her sister and another person to Walthill, Nebraska on the Omaha Indian Reservation when an argument ensued. Payer stopped the car and ordered her sister to get out of the car. As her sister and the other passenger were walking away, Payer came at them with her SUV, drove over a curb onto the sidewalk and struck her sister. As a result of this incident, PayerМs sister suffered a broken leg and had to undergo surgery at the Mercy Medical Center in Sioux City, Iowa.

This case was investigated by the Federal Bureau of Investigation.
