FORMER WAL MART PHARMACIST
PLEADS GUILTY TO UNLAWFULLY DISPENSING
AND MISBRANDING CONTROLLED SUBSTANCES
CONCORD, NEW HAMPSHIRE: United States Attorney John P. Kacavas announced that John F. Reilly, a 59-year-old resident of Dover, New Hampshire and former pharmacist, has pleaded guilty to unlawfully dispensing controlled substances and unlawfully misbranding the controlled substances.
On four separate occasions in 2005 and 2006, Reilly knowingly dispensed quantities of Schedule III controlled substances, including Vicodin, to a customer of the Wal-Mart pharmacy in Newington, New Hampshire who did not have a valid prescription for the drugs. Reilly committed the offenses while he was in charge of the pharmacy. After the offenses were committed, Reilly voluntarily surrendered his pharmacist license to the State of New Hampshire.
Reilly will be sentenced by United States District Court Judge Joseph A. DiClerico, Jr. on July 13, 2010. The maximum prison term for unlawful dispensing controlled substances is five years. The maximum prison term for unlawfully misbranding controlled substances is one year.
This case was investigated by the Drug Enforcement Administration, New England Division; the Food and Drug Administration, Office of Criminal Investigations; the New Hampshire Board of Pharmacy, and the Newington Police Department.
The case is being prosecuted by Assistant United States Attorney Mark Irish and Special Assistant United States Attorney Shannon Singleton.
