LAS VEGAS - - A federal jury has found that the United States Postal Service did not retaliate against a Henderson Post Office employee when she was demoted from her customer service supervisor position to part-time letter carrier, announced Greg Brower, U.S. Attorney for Nevada.

In 2004, Valerie Duffley was employed as a Customer Service Supervisor at the Valle Verde Station Post Office in Henderson, Nevada. In August of that year, Duffley was demoted to a part-time letter carrier position for failing to follow Postal Service mileage reimbursement policies and procedures.

In July 2006, Duffley filed a lawsuit against the United States Postal Service in U.S. District Court in Las Vegas, claiming, among other things, that her demotion was in retaliation for engaging in protected “EEO” (equal employment opportunity) activities.

On April 28, 2009, following a five-day trial, the jury found that Duffley’s demotion was not in retaliation for protected activity, and returned a verdict in favor of the United States Postal Service.

The case was tried by Assistant United States Attorney Patrick A. Rose.
