WHAT IS A VICTIM IMPACT STATEMENT

This is a victim's written statement which is submitted to the United States Attorney's Office and forwarded to Probation who then submits it to the Judge to review before sentencing the defendant. It personalizes to the Judge the emotional, physical, and financial impact you and others have suffered as a direct result of this crime. Since some victims are uncomfortable with completing a formal statement for review, the Judge will also consider a personal letter.

SYRACUSE, NEW YORKLINDA JONES, age 50, of Reynoldsville, Pennsylvania and LESLIE KNOX, age 62, of Red House, West Virginia pled guilty today before United States District Judge David N. Hurd in Utica, New York to causing false and misleading financial information and reports to be filed with the U.S. Securities and Exchange Commission ("SEC"). JONES and KNOX were senior sales and marketing executives with The Penn Traffic Company ("Penn Traffic"), a publicly-traded grocery retailer and wholesaler headquartered in Syracuse, New York. As a result of their guilty pleas, JONES and KNOX each face a maximum term of up to 20 years in prison; a $5,000,000 fine; and three years of supervised release. They were released pending sentencing, which has been scheduled before Judge Hurd on January 8, 2010 in Utica.

Judge David N. Hurd, of the United States District Court for the Northern District of New York, announced today that change of plea hearings for each of the above-named defendants has been scheduled for Friday, August 28, 2008 at 11am. The hearing will be conducted in the courtroom of District Judge Hurd, which is located at the United States Courthouse, Alexander Pirnie Federal Building, 10 Broad Street, Utica, New York.

It is anticipated that the defendants will each enter a plea of “guilty” to Count Three of Indictment 07-CR-395 at the change of plea hearing. The hearing is, of course, open to all. Individuals wishing to be heard should contact the Syracuse U.S. Attorney’s Office Victim Witness Specialist, Ivy Schoff at (315) 448-0672 or email Ivy at Ivy.schoff@usdoj.gov to confirm the most current date and time of the hearing. Ivy will be available in court on August 28th to assist any victims that wish to attend this hearing. Inquiries for the U.S. Attorney’s Office should be made at 315-448-0672.
