The defendants
in this case have been charged with participating in a scheme to defraud investors
in connection with Madison Deane & Associates ("Madison Deane"),
a now-defunct foreign currency "boiler room." The defendants were
arrested in November 2003 in connection with a large-scale undercover investigation
of criminal activity in the foreign currency or "forex" markets conducted
by the United States Attorney's Office, the FBI, and the Commodities Futures
Trading Commission ("CFTC"). The civil actions filed by the CFTC against
the defendants in this case were assigned to Judge George B. Daniels, who issued
orders temporarily restraining all of the defendants' assets and appointed Brian
Rosner, Esq., to act as Receiver.

All seven defendants indicted in connection with Madison Deane pleaded guilty in July and August 2005. For details, see the August 15, 2005 press release. The last of the 7 Madison Deane defendants pleaded guilty Monday, August 15, 2005. All sentencings will be held in Judge Preska's courtroom, United States District Court, 500 Pearl Street, Courtroom 12A, New York, New York, 10007.

03/15/2006 - Matthew Salinas sentenced to 3 years probation w/special condition of 6 months home confinement, $14,000 restitution.
04/26/06 - Judge Preska sentenced Damon Ripley, on both indictments, as follows: 140 months imprisonment (& 120 months, to run concurrent); 5 years supervised release (& 3 years supervised release, to run concurrent); $900 special assessment; $226,522 restitution
04/27/06 - Judge Preska sentenced defendant George Omeste to 70 months imprisonment, 3 years supervised release, restitution of $116,600.30 on 04 Cr. 145 and $5,129,687.00 on 04 Cr. 156, and a $200 special assessment. Institutional surrender no later than 6/30/06.
04/28/06 - Judge Preska sentenced defendant Vito Napoletano to 87 months imprisonment, 3 years supervised release, restitution of $116,600.30 on 04 Cr. 145 and $5,129,687.00 on 04 Cr. 156, and a $300 special assessment. Institutional surrender no later than 6/30/06.
04/28/06 - Judge Preska sentenced defendant Leonard Basman to 46 months imprisonment, 2 years supervised release, $5,129,687 in restitution and a $100 special assessment. Institutional surrender no later than 6/30/06.
