William J. Edwards, Acting United States Attorney for the Northern District of Ohio, today announced that the Grand Jury returned an Indictment charging Glenn Kerns with one count of Solicitation of Payment for Testimony and Withholding Testimony.
Kerns, age 72, resides in New Philadelphia, Ohio.
The Indictment alleges that from on or about January 28, 2008 through on or about February 5, 2008, Kerns demanded, sought, accepted and agreed to receive and accept, between approximately $50,000 and $100,000, for and because of testimony, under oath and affirmation, to be given by the defendant Kerns as a potential witness in a case before the United States District Court for the Northen District of Ohio, Eastern Division, Case No. 5:03CV1827, entitled Anthony Harris v. Amanda Spies Bornhorst, et al., and for and because of his absence therefrom.
If convicted, the defendant’s sentence will be determined by the Court after review of factors unique to this case, including the defendant's prior criminal record, if any, the defendant’s role in the offense and the characteristics of the violation. In all cases the sentence will not exceed the statutory maximum and in most cases it will be less than the maximum.
This case is being prosecuted by Assistant U.S. Attorney Justin J. Roberts, following investigation by the Cleveland Office of the Federal Bureau of Investigation.
An Indictment is only a charge and is not evidence of guilt. A defendant is entitled to a fair trial in which it will be the government’s burden to prove guilt beyond a reasonable doubt.
