Mexican National Pleads Guilty To Illegal Reentry
Muskogee, Oklahoma - The United States Attorney’s Office for the Eastern District of Oklahoma, announced today that ELEAZAR RIOS-FIGUEROA a/k/a Elizar Figureoa Rios, age 32, of Oaxaca, Mexico, pled guilty to Illegal Reentry of a Previously Deported Alien, in violation of Title 8, United States Code, Sections 1326(a).
The charge arose from an investigation by the Department of Homeland Security, Immigration and Customs Enforcement (ICE). The defendant was indicted in February, 2013.
The Indictment alleged that on or about January 24, 2013, in the Eastern District of Oklahoma, the defendant, an alien, was found in the United States after having been deported and removed from the United States on or about September 1, 2008, at or near Tucson, Arizona, and not having obtained the express consent of the Attorney General of the United States or his successor, the Secretary of Homeland Security, to reapply for admission to the United States.
The Honorable Kimberly E. West, Magistrate Judge in the United States District Court for the Eastern District of Oklahoma, in Muskogee, accepted the guilty plea and ordered the completion of a presentence report. Sentencing will be scheduled following its completion. The defendant will remain in custody pending sentencing.
The statutory range of punishment is not more than 2 years imprisonment and/or up to a $250,000.00 fine.
