February 2, 2006- PHILADELPHIA – United States Attorney Patrick L. Meehan today announced the filing of an information* against Donald M. Nicholson and Leo F. Medley. The indictment charges Nicholson and Medley with conspiracy to make false claims, false claims and bribery.

It is charged that from September 30, 1999 through September 2001, Nicholson and Medley conspired to defraud the government of approximately $385,527.61. During the course of the conspiracy, Nicholson was the Director of General Services Administration (GSA), Federal Technology Service, IT Solutions, New York, New York. Medley was a Senior Configuration Manager for System Integration and Management, Inc. (SIM), a Virginia corporation. The indictment alleges that Nicholson and Medley conspired to fraudulently submitted other direct cost invoices, which were ultimately billed to the government. Other direct costs are items other than personnel and travel costs billed by a contractor who enters into a contract with the government.

The indictment also alleges that while Nicholson was still employed at GSA, Medley allegedly paid Nicholson approximately $156,550 in bribes.

If convicted, Nicholson faces twenty-five years imprisonment, three years of supervised release, a $500,000 fine, and a $300 special assessment.

If convicted, Medley faces twenty-five years imprisonment, three years supervised release, a $500,000 fine, and a $300 special assessment.

This case was investigated by the General Services Administration Office of Inspector General and Department of Defense, Defense Criminal Investigative Service. This case has been assigned to Assistant United States Attorney Kenya S. Mann.
