April 13, 2007 - United States Attorney Patrick L. Meehan today announced the filing of an indictment* against Lamar Brown charging him with: felon in possession of a firearm, in violation of 18 U.S.C. § 922(g); carrying a firearm during and in relation to a drug trafficking crime in violation of 18 U.S.C. § 924(c); and possession with the intent to distribute crack cocaine, in violation of 21 U.S.C. § 841(1)(1) . These offenses arise from the defendant’s attempt to sell crack cocaine to under cover Philadelphia Police Officers on March 3, 2006, in the vicinity of S. 58th and Norfolk Streets in Philadelphia and his illegal possession of a firearm while attempting to make the sale.

The maximum authorized, and mandatory minimum, prison sentence for possession with the intent to distribute cocaine base in this context is 30 years imprisonment, a mandatory term of supervised release of 6 years and up to a lifetime period of supervised release, a $2 million fine, and a $100 special assessment.

The mandatory prison sentence for use of a firearm during a drug trafficking offense, in violation of 18 U.S.C. § 924(c) in this context is life imprisonment, with a mandatory minimum of 5 years imprisonment, consecutive to any sentence imposed in connection with any other offense.

The maximum authorized prison sentence for felon in possession of a firearm in violation of 18 U.S.C. § 922(g) in this context is 15 years. This charge also carries with it a maximum fine of $250,000, a three year term of supervised release, and a $100 mandatory special assessment.

The case was investigated by the ATF Task Force and the Philadelphia Police Department, and has been assigned to Assistant United States Attorney Joel D. Goldstein.
