June 26, 2007 - United States Attorney Patrick L. Meehan today announced the filing of a two-count Information* against Joeann Martin Barnes, charging her with one count of false statements, in violation of 18 U.S.C. § 1001, and one count of theft of government money, in violation of 18 U.S.C. § 641. According to the charges, Joeann Martin Barnes submitted a false statement regarding her marital status to the Department of Veteran’s Affairs (VA) in connection with her eligibility to continue to receive benefits as the widow of Theodore Martin, a veteran. Barnes’s false statement caused the VA to overpay Barnes approximately $136,948 in benefits which she knew she was not entitled. According to the charges, Barnes also failed to disclose and intentionally concealed the death of her second husband, Leroy Barnes, a retired railroad worker, from the Railroad Retirement Board (RRB). By doing so, Barnes converted to her own use approximately $132,968 in retirement benefits, which the RRB intended for Leroy Barnes, and which Barnes knew she was not entitled to receive. In total, Barnes defrauded the VA and the RRB out of approximately $269,916.

If convicted the defendant faces a maximum possible sentence of 15 years imprisonment, three years of supervised release, a $500,000 fine, and a $200 special assessment.

The case was investigated by the Department of Veteran’s Affairs, Office of the Inspector General; the Railroad Retirement Board, Office of the Inspector General; and has been assigned to Special Assistant United States Attorney Robert W. Flynn.
