
Mountaintop couple charged with filing false tax returns
The United States Attorney’s Office for the Middle District of Pennsylvania announced today it has filed a criminal Information against Ann C. West, age 41 and Robert K. West, age 46, of Mountaintop, Pennsylvania.
According to United States Attorney Peter J. Smith, the Information alleges that Ann C. West filed a false tax return and Robert K. West, her husband, was charged with conspiracy. It is alleged that the Wests’ started a Schedule C home construction business in 2002 and that, from 2003 through 2006, the company under-reported its gross receipts and over reported business expenses resulting in an under reporting of taxable income. The tax loss to the government is approximately $140,000.
If convicted, Robert West could be imprisoned for a statutory maximum term of five years and fined the sum of $250,000. Ann West could be imprisoned for a statutory maximum term of three years and fined the sum of $100,000.
United States Attorney Smith stated the charges are the result of investigation by the Internal Revenue Service. Prosecution is assigned to Assistant United States Attorney Barbara Kosik Whitaker.

A charged Defendant is presumed innocent until a jury returns a unanimous finding that the United States has proven the defendant’s guilt beyond a reasonable doubt or until the defendant has pled guilty to the charges.
