CLARKS SUMMIT MAN SENTENCED FOR HIS ROLE IN THE FRAUD AGAINST THE LACKAWANNA COUNTY’S WORKERS COMPENSATION FUND

Dennis C. Pfannenschmidt, United States Attorney for the Middle District of Pennsylvania; Janice K. Fedarcyk, Special Agent in Charge, Federal Bureau of Investigation; and Don Fort, Special Agent in Charge, Internal Revenue Service announced that Marc Boriosi, age 38 of Clarks Summit, Pennsylvania, was sentenced today by United States District Court Senior Judge Edwin Kosik to a total of 10 months’ imprisonment, three years of supervised release and in excess of $500,000 in restitution for fraud, money laundering, and tax charges in connection with the administration of the Lackawanna County Workers’ Compensation fund.

According to U.S. Attorney Pfannenschmidt, Boriosi pleaded guilty to a two count felony Information on January 10, 2008 and has been cooperating with federal authorities in connection with the federal investigation and prosecution of Charles A. Costanzo. A Superceding Indictment returned by a federal Grand Jury against Costanzo last November stated that from on or about November 11, 2004, and continuing until on or about September 5, 2005, Boriosi conspired with Costanzo to misappropriate approximately $647,260 of Lackawanna County funds. Boriosi had pleaded guilty to one count of conspiracy and one count of tax evasion in connection with the scheme. Boriosi was a government witness at Costanzo’s trial in April, 2009. Costanzo was convicted of a nineteen counts charged in the Indictment.

Costanzo was sentenced on August 13 to a total of 70 months’ imprisonment and in excess of $500,000 in restitution. The Judge credited Costanzo with $142,820 of Costanzo’s property previously forfeited to Lackawanna County.

U.S. Attorney Pfannenschmidt praised the dedication of the investigating agencies and Assistant United States Attorney Lorna Graham for the successful prosecution of both Boriosi and Costanzo.
