YORK COUNTY CONSTABLE SENTENCED TO 13 MONTHS IMPRISONMENT FOR FAILING TO FILE INCOME TAX RETURNS

Martin C. Carlson, United States Attorney for the Middle District of Pennsylvania, announced today that Kelly L. Deardorff, age 42, of York, Pennsylvania, was sentenced to 13 months imprisonment and ordered to pay $124,072 in restitution for failing to file his federal income tax returns for the years 2001 through 2005. Deardorff was ordered to report to prison on July 7, 2008 to commence service of his sentence.

Deardorff is an elected constable in York County, Pennsylvania and is paid by York County, several district justices and private attorneys for serving legal documents, executing warrants and other related activities. Deardorff admitted that he earned over $100,000 each year but stopped filing income tax returns in 1997 when he filed his 1996 tax return.

The case was investigated by the Criminal Investigation Division of the IRS and is assigned to Assistant United States Attorney Bruce Brandler for prosecution.
