ALBRIGHTSVILLE COUPLE CHARGED WITH FIREARMS VIOLATIONS

Martin C. Carlson, United States Attorney for the Middle District of Pennsylvania, announced that a federal grand jury returned an indictment last week charging two Albrightsville residents with firearms violations.


Carlson stated that Jacqueline Miceli, formerly known as Robert Miceli, age 53, and Noreen Miceli, age 50, were charged with making false statements to acquire firearms, conspiracy to make false statements to acquire firearms, and aiding and abetting the possession of firearms by a convicted felon.


The charges stem from an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Pennsylvania State Police. The indictment alleges that the Micelis illegally obtained 50 firearms and illegally possessed more than 60 firearms between March 2007 and March 2008.


Carlson stated that both defendants face up to 10 years in prison and a $250,000 fine if convicted of the making false statements charge and/or the felon in possession charge. They each would face up to five years in prison and a $250,000 fine if convicted of the conspiracy charge.


Carlson noted that Assistant United States Attorney Francis P. Sempa is prosecuting the case.

An Indictment or Information is not evidence of guilt but simply a description of the charge made by the Grand Jury and/or United States Attorney against a defendant. A charged Defendant is presumed innocent until a jury returns a unanimous finding that the United States has proven the defendant’s guilt beyond a reasonable doubt or until the defendant has pled guilty to the charges.
