Eagle Butte Man Indicted for Child Abuse

Pierre, SD

United States Attorney Brendan V. Johnson announced that an Eagle Butte man has been indicted by a federal grand jury for Assault Resulting in Serious Bodily Injury and Child Abuse. Nicholas Allan Rivers, age 29, was indicted by a federal grand jury on October 13, 2009, for Assault Resulting in Serious Bodily Injury and Child Abuse. He appeared before United States Magistrate Judge Mark A. Moreno on October 22, 2009, and pled not guilty to the indictment. The maximum penalty upon conviction is 15 years in custody, a $250,000 fine, or both; 5 years of supervised release; and $100 Special Assessment. Restitution may also be ordered. The charges are merely an accusation, and Rivers is presumed innocent until and unless proven guilty. The investigation is being conducted by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Agency, and Assistant United States Attorney Mikal Hanson is prosecuting the case. Rivers was remanded to the custody of the United States Marshal. A trial date has not yet been set. # # #
