United States Attorney Brendan V. Johnson announced that Allen C. Shillingstad, age 46, of Wakpala, was convicted of Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury as a result of a federal jury trial in Aberdeen, South Dakota. The charges carry a maximum penalty of ten years imprisonment, a $250,000 fine, or both; three years of supervised release, and a $100 special assessment for each count. Shillingstad was indicted by a federal grand jury on May 12, 2009, for Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury. The charges stem from an assault on a Wakpala woman in December 2008. This case was investigated by the Standing Rock Sioux Tribal Law Enforcement Agency and prosecuted by Assistant United States Attorney Eric Kelderman. The defendant will be sentenced in approximately thirty days after a presentence investigation has been completed. A presentence investigation was ordered, and a sentencing hearing will be set at a later date. The defendant was remanded to the custody of the United States Marshal. # # # |
