United States Attorney Brendan V. Johnson announced that Timmi White Bird, 19, of St. Francis, appeared before United States District Judge Charles B. Kornmann on October 23, 2009, and pled guilty to Assault Resulting in Substantial Bodily Injury. The maximum penalty upon conviction is five years imprisonment, a $250,000 fine, or both, and a period of supervised release of three years. Additionally, a $100 assessment to the Victims Assistance Fund and restitution may be ordered. The charge relates to the events that took place in Todd County on June 14, 2009, when Defendant assaulted an individual who had not attained the age of 16 years, and said assault resulted in substantial bodily injury. The investigation was conducted by Rosebud Sioux Tribal Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Kevin J. Krull. A presentence investigation was ordered, and a sentencing date was set for January 25, 2010. The Defendant was remanded to the custody of the United States Marshal pending sentencing. # # # |
