United States Attorney Brendan V. Johnson announced that Richard Irving, age 21, of Ft. Thompson, appeared before United States District Judge Charles B. Kornmann on October 23, 2009, and pled guilty to count II of the indictment that charged him with Failure to Register as a Sex Offender. The maximum penalty upon conviction is 10 years imprisonment, a $250,000 fine, or both, 5 years to life of supervised release, and $100 to the Victims Assistance Fund. Irving was required to register as a sex offender in the location he was living based upon a previous sex offense conviction. The charge stems from Irving failing to register in Ft. Thompson following his relocating there between March and May of 2009. The investigation was conducted by the Bureau of Indian Affairs, Crow Creek Agency. The case is being prosecuted by Assistant United States Attorney Jay Miller. A presentence investigation was ordered, and a sentencing date was set for January 25, 2010. The defendant was remanded to the custody of the U.S. Marshal pending sentencing. # # # |
