United States Attorney Brendan V. Johnson announced that a Mobridge, South Dakota, man charged with Felon in Possession of a Firearm was sentenced on November 2, 2009, by United States District Judge Charles B. Kornmann. Justin Paul Wirkuty, age 50, was sentenced to 51 months of custody, 3 years of supervised release, and $100 special assessment to the Victims Assistance Fund. Wirkuty was indicted for Felon in Possession of a Firearm by a federal grand jury on February 11, 2009. The charge relates to Wirkuty’s possession of a firearm following two earlier felony convictions—the first in Oregon in 1988 for First Degree Sodomy, and the second in South Dakota in 2008 for Failure to Register as a Sex Offender. He pled guilty to Felon in Possession of a Firearm on August 3, 2009. This case was investigated by the Federal Bureau of Investigation, Bureau of Alcohol, Tobacco, Firearms & Explosives, and the Cheyenne River Sioux Tribe Detective Division. Assistant United States Attorney Mikal Hanson prosecuted the case. Wirkuty was immediately turned over to the custody of the United States Marshal. # # # |
