Illegal Alien Sentenced to 15 Months Imprisonment

Acting U.S. Attorney Dennis R. Holmes announced that a man charged with Illegal Reentry After Deportation was sentenced on October 2, 2009, by Chief U.S. District Judge Karen E. Schreier. Jose Garibay-Barajas, a/k/a Luis Garibay-Barajas, age 34, was sentenced to 15 months imprisonment and ordered to pay $100 to the Victims Assistance Fund. He will be immediately deported upon release. Garibay-Barajas was indicted for Illegal Reentry After Deportation by a federal grand jury on May 5, 2009, and pled guilty on September 2, 2009. Garibay-Barajas was arrested by state authorities on February 9, 2009, and found to be in possession of over ten pounds of marijuana. During the booking process, it was revealed that Garibay-Barajas was previously removed from the United States through Otay Mesa, California, and prior to this offense, he had not submitted requests to the Secretary of the Department of Homeland Security or the Attorney General for permission to enter the United States. This case was investigated by Homeland Security (DHS), Immigration and Customs Enforcement (ICE), and Assistant U.S. Attorney Jeremy R. Jehangiri prosecuted the case. Garibay-Barjas was immediately turned over to the custody of the U.S. Marshal. # # #
