Illegal Alien Sentenced for Illegal Re-entry in to the US after Deportation

Rapid City, SD

U.S. Attorney Brendan V. Johnson announced that a man charged with illegally residing in the United States was sentenced on October 23, 2009, by Chief U.S. District Judge Karen E. Schreier. Marcos Martinez, age 29, was sentenced to three months incarceration. Marcos Martinez was indicted for Illegal Re-entry After Deportation by a federal grand jury on August 25, 2009. Marcos' unlawful residency was discovered in Rapid City by law enforcement authorities responding to a domestic violence complaint. Martinez is a citizen and national of Mexico who was previously deported from the United States on October 26, 2008, through Hidalgo, Texas. He pled guilty to the charge on September 21, 2009, having not made any request to the Secretary of the Department of Homeland Security and/or the Attorney General of the United States for permission to enter the United States. This case was investigated by the United States Marshal's Office. Assistant U.S. Attorney Gregg S. Peterman prosecuted the case. Martinez was immediately turned over to the custody of the U.S. Marshal. # # #
