Eagle Butte Man Indicted on Assault Charges

United States Attorney Brendan V. Johnson announced that an Eagle Butte man has been indicted by a federal grand jury for allegedly assaulting two women and a man in Eagle Butte on September 6, 2010, and the assault resulted in serious bodily injury to one of the women and the man.
Leland B. Benoist, age 31, was indicted by a federal grand jury on December 13, 2010, for two counts of Assault with a Dangerous Weapon and two counts of Assault Resulting in Serious Bodily Injury. He appeared before United States Magistrate Judge Mark A. Moreno on December 21, 2010, and pled not guilty to the indictment. The maximum penalty upon conviction on each count is 10 years in custody, a $250,000 fine, or both; five years of supervised release; and a $100 Special Assessment. Restitution may also be ordered. The charge is merely an accusation, and Benoist is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Division. Assistant United States Attorney Mikal Hanson is prosecuting the case. Benoist was remanded to the custody of the United States Marshal. A trial date has not yet been set.
