Eagle Butte Man Arraigned on Assault of a Federal Officer

U.S. Attorney Brendan V. Johnson announced that an Eagle Butte man has been indicted by a federal grand jury for Assaulting a Federal Officer.

Lester R. Metcalf, age 28, was indicted by a federal grand jury on January 11, 2011. He appeared before U.S. Magistrate Judge Mark A. Moreno on February 4, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 8 years' imprisonment. The charge is merely an accusation, and Metcalf is presumed innocent until and unless proven guilty.

The investigation is being conducted by Cheyenne River Sioux Tribe Law Enforcement. Assistant U.S. Attorney Marie H. Ruettgers is prosecuting the case. Metcalf was detained pending release on February 7, 2011, to Stepping Stones. A trial date has not yet been set.
