Lower Brule Man Arraigned on Drug Charges

U.S. Attorney Brendan V. Johnson announced that a Lower Brule man has been indicted by a federal grand jury for Possession with Intent to Distribute a Controlled Substance.

Vincent Battese, age 24, was indicted by a federal grand jury in February 2011. He appeared before U.S. Magistrate Judge Mark A. Moreno on May 6, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 5 years' imprisonment. The charge is merely an accusation, and Battese is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant U.S. Attorney Jay Miller is prosecuting the case. Battese was released on bond pending trial. A trial date has not yet been set.
