LaRoche was indicted by a federal grand jury on January 11, 2011. In May 2009, LaRoche, along with others, burglarized Tuffy's Bar and Grill in Lower Brule, breaking into the building and taking alcohol from the business. He pled guilty on March 8, 2011.

This case was investigated by the Bureau of Indian Affairs, Lower Brule Agency. Assistant US Attorney Eric Kelderman prosecuted the case.

LaRoche was immediately turned over to the custody of the US Marshal.
