U.S. Attorney Brendan V. Johnson announced that a Mission man charged with Assault Resulting in Serious Bodily Injury was sentenced on June 20, 2011, by U.S. District Judge Roberto A. Lange. Benjamin Wayne Kitteaux, age 23, was sentenced to 46 months' custody, $756.31 restitution, and two years of supervised release.

During the early morning hours of July 13, 2010, the male victim was assaulted by Kitteaux and two others at the Sunrise Apartment Complex in Todd County. The victim was randomly attacked by all three men, being kicked and hit in the head and body. As a result of the assault, the victim suffered two fractures of his jaw and multiple other injuries.

Kitteaux was indicted by a federal grand jury in December 2010. He pled guilty to one count of the indictment in March 2011.

This case was investigated by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.

Kitteaux was immediately turned over to the custody of the U.S. Marshal
