Rosebud Man Pleads Guilty to Simple Assault

United States Attorney Brendan V. Johnson announced that Michael O'Rourke, age 25, of Rosebud, South Dakota, appeared before United States Magistrate Judge Mark A. Moreno on August 3, 2011, and pled guilty to Simple Assault. The maximum penalty upon conviction is 6 months of imprisonment, a $5,000 fine, or both, and a special assessment of $10 to the Victim Assistance Fund (VAF).

The charge stems from an incident on February 6, 2011, when O'Rourke assaulted his wife, Robbie O'Rourke, which resulted in a fracture to Robbie O'Rourke's left forearm.

The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Marie H. Ruettgers.

A presentence investigation was ordered, and a sentencing date was set for September 29, 2011. The defendant was remanded to the custody of the United States Marshal pending sentencing.
