Washington Woman Pleads Not Guilty to Failing to Pay Legal Child Support

United States Attorney Brendan V. Johnson announced that a Washington woman has been indicted by a federal grand jury for failing to pay over $10,000 in past due child support.

Misty D. Wise, a/k/a Misty D. Clarke, age 37, was indicted by a federal grand jury on February 8, 2011, for Failure to Pay Legal Child Support. She appeared before United States Magistrate Judge Veronica L. Duffy on May 13, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is two years of imprisonment, a $250,000 fine, or both; one year of supervised release; a $100 special assessment to the Victim Assistance Fund; and child support restitution owing at the time of sentencing.

The charge is merely an accusation, and Wise is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Department of Health and Human Services, Office of Inspector General. Wise was released on bond pending trial. A trial date has not yet been set.
