South Dakota Woman Indicted for Assaulting a Federal Officer

United States Attorney Brendan V. Johnson announced that an Allen, South Dakota, woman has been indicted by a federal grand jury for assaulting a federal officer at Allen on September 12, 2010.

Delmarie Wounded Head, a/k/a Delmarie Tallman, age 26, was indicted by a federal grand jury on April 13, 2011, for Assaulting a Federal Officer. She appeared before United States Magistrate Judge Veronica L. Duffy on June 3, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is eight years in custody, a $250,000 fine, or both. Restitution may also be ordered. The charge is merely an accusation, and Wounded Head is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Bureau of Indian Affairs and the Oglala Sioux Tribe Department of Public Safety. Assistant United States Attorney Eric Kelderman is prosecuting the case. Wounded Head was remanded to the custody of the U.S. Marshal. A trial date has not yet been set.
