Wounded Head was indicted by a federal grand jury on April 13, 2011. In September 2010, at Allen, Wounded Head struck an Oglala Sioux Tribe law enforcement officer with a metal bar after the officer responded to a domestic complaint. Wounded Head pled guilty to the offense on July 15, 2011.

This case was investigated by the Bureau of Indian Affairs and the Oglala Sioux Tribe-Department of Public Safety. Assistant U.S. Attorney Eric Kelderman prosecuted the case.
