California Man Sentenced for Failure to Pay Legal Child Support

US Attorney Brendan V. Johnson announced that a San Diego, California, man charged with Failure to Pay Legal Child Support was sentenced on April 11, 2011, by Chief US District Judge Karen E. Schreier. Austin R. Harper, age 47, was sentenced to five years of probation, six months of community confinement, a $100 special assessment to the Victim Assistance Fund, and child support restitution in the amount of $27,297.

Harper was indicted for failing to pay over $24,000 in past due child support by a federal grand jury on October 5, 2010. At the time of indictment, Harper had never made a child support payment since his obligation had been established. As of September 28, 2010, the total arrearage amount was $24,731. He pled guilty to the charge on January 26, 2011.

This case was investigated the Department of Health and Human Services, Office of Inspector General. Assistant US Attorney Thomas J. Wright prosecuted the case.
