Rapid City Man Guilty of Escape

United States Attorney Brendan V. Johnson announced that Wilbur Toledo Flute, age 38, of Rapid City, appeared before U.S. District Judge Jeffrey L. Viken on May 11, 2012, and pleaded guilty to a charge of Escape. The maximum penalty upon conviction is 5 years' imprisonment and/or a $250,000 fine.
In April 2012, Flute left the Community Alternatives of the Black Hills, where he was serving part of a federal sentence, without permission, and did not return. The investigation was conducted by the U.S. Marshal’s Service. The case is being prosecuted by Assistant U.S. Attorney Eric Kelderman.
A presentence investigation was ordered. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
