Texas Man Sentenced for Failure to Pay Legal Child Support

US Attorney Brendan V. Johnson announced that a Fort Worth, Texas, man charged with Failure to Pay Legal Child Support was sentenced on June 4, 2012, by Chief US District Judge Karen E. Schreier. David L. Oxner, age 44, was sentenced to 5 years of probation, 6 months of home detention, a $100 special assessment to the Victim Assistance Fund, and child support restitution in the amount of $40,390.02.

Oxner was indicted for failing to pay over $35,000 in past due child support by a federal grand jury on June 7, 2011. David L. Oxner was ordered by the Second Judicial Circuit Court, Minnehaha County, South Dakota, to pay $308.52 per month for his minor children, commencing May 7, 1995. Said support was modified to $442.56 per month commencing October 1, 1995. At the time of indictment, he had not made a child support payment since May of 2009, and the total arrearage amount was $35,236.46. He pleaded guilty to the charge on March 16, 2012.

This case was investigated the Department of Health and Human Services, Office of Inspector General. Assistant US Attorney Thomas J. Wright prosecuted the case.
