[CHATTANOOGA, TENNESSEE] -A federal grand jury in Chattanooga, Tennessee, returned a ten (10) count superseding indictment against Kale Castle, 64, of Marion County Tennessee; Henry Outlaw, 73, of Hamilton, County, Tennessee; Timothy Neal, 39, of Hamilton County, Tennessee; Jimmy Neal, 22, of Hamilton County, Tennessee; Tony Neal, 36, of Hamilton County, Tennessee; Brandon Nolan, 26, of Sequatchie County, Tennessee; Andrew Morgan, 25, of Hamilton County, Tennessee; Oren Hall, 72, of Hamilton County, Tennessee; Angela Hunt, 38, of Hamilton County, Tennessee; and, Sammy McGhee, 72, of Hamilton County, Tennessee. Among other charges outlined in the Superseding Indictment attached to this press release, these individuals were charged with conspiring to distribute oxycodone and hydrocodone. A previous indictment by a federal grand jury in Chattanooga, Tennessee, charges James Moon, 65, of Marion County, Tennessee; Cody Tigner, 19, of Marion County, Tennessee; Tonya Francis, 36, of Marion County, Tennessee; and Mitchell Francis, 52, of Marion County, Tennessee, with related drug charges.
A trial date has been set for November 4, 2008, before the Honorable Harry S. Mattice, United States District Court Judge, Chattanooga, Tennessee. If convicted, the defendants each face up to 20 years imprisonment, a $1,000,000 fine and three (3) years supervised release.
United States Attorney Russ Dedrick stated, “The distribution of controlled substances such as oxycodone and hydrocodone have brought great harm upon our communities in east Tennessee. The United States, in conjunction with state and local agencies, will vigorously investigate the sources and distributors of these pharmaceutical drugs; and, prosecute these cases as a priority to protect the public from the harm they inflict upon their victims.”
These indictments were the result of an investigation by the Tennessee Bureau of Investigation (TBI), Drug Enforcement Administration (DEA); Marion County Sheriff’s Office and the Hamilton County Sheriff’s Office. Assistant U.S. Attorney Scott Winne will represent the United States.
Members of the public are reminded that an indictment constitutes only charges and that every person is presumed innocent until their guilt has been proven beyond a reasonable doubt.
