Memphis Area Return Preparer Sentenced

Memphis, TN –  James Holman, 41, of Hernando, Mississippi, was sentenced yesterday, May 14, 2008,  by U.S. District Judge J. Daniel Breen to serve 36 months in prison, followed by 1 year of supervised release announced David Kustoff, United States Attorney for the Western District of Tennessee.  Judge Breen also ordered Holman to pay restitution of $911,825.00 to the Internal Revenue Service.

Holman pled guilty in August 31, 2006, to six counts of aiding and assisting in the preparation of a false federal income tax return.  As part of his sentence, Judge Breen prohibited Holman from preparing or assisting in the preparing of income tax returns for other individuals. 

According to the indictment, Holman operated tax preparation services in Memphis, Tennessee and Cincinnati, Ohio, with Xadimul Samba. The indictment charges that both Holman prepared returns for individuals that claimed deductions for items that he well knew and believed the taxpayers were not entitled to claim in said amounts, but of lesser amounts. Holman admitted during the hearing that he prepared tax returns for others that claimed false Itemized Deductions (Schedule A) and/or false business deductions (Schedule C) for calendar years 2001 and 2002.  Samba’s trial is scheduled for April 2007.

This investigation was conducted by IRS Criminal Investigation. Assistant U.S. Attorneys Stephen C. Parker is handling the case for the United States.
