(BEAUMONT, TX)   United States Attorney Rebecca A. Gregory announced today that a 22 year-old Cleveland, Texas man has been sentenced to 33 months in federal prison for receiving a firearm while under indictment in the Eastern District of Texas.

            ROBERT TYRONE GREEN  had previously pleaded guilty on December 18, 2007, to a charge of receiving a firearm while under indictment.  Green was sentenced earlier today by United States District Judge Thad Heartfield.

            According to information presented in court, Green sold a nine millimeter pistol that had been reported as stolen to a confidential informant.  Further investigation determined that Green was under indictment in state court for Evading Arrest or Detention with a Vehicle and Tampering with Physical Evidence.  In December, 2006, he had been placed on five years deferred adjudication for both offenses, and as such, was under felony indictment at the time he sold the firearm in August, 2007.

            This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Cleveland Police Department, and was prosecuted by Assistant United States Attorney Randall Fluke.
