Montpelier Business Undertakes Measures to Comply with the Americans with Disabilities Act

Burlington, VT – The Office of the United States Attorney for the District of Vermont has resolved a complaint alleging that Vianor Tire & Auto Service in Montpelier, Vermont was not in compliance with Title III of the Americans with Disabilities Act ("ADA"). Title III of the ADA prohibits a public accommodation from denying an individual or a class of individuals, on the basis of a disability, the opportunity to participate in or benefit from the goods, services, facilities, or accommodations of an entity. Title III requires a public accommodation to remove architectural barriers to access in existing facilities where it is readily achievable to do so. Accessible parking is a top barrier removal priority. The complainant alleged that Vianor Tire had no designated accessible parking spaces and inadequate signage. On January 2, 2013, the U.S. Attorney's Office closed its investigation and issued a Letter of Resolution after confirming that Vianor Tire had undertaken measures to remedy the alleged deficiencies. 

Assistant United States Attorney Nikolas P. Kerest, in cooperation with the Disability Rights Section of the Civil Rights Division of the Department of Justice, handled these matters on behalf of the United States. Further information on the ADA and its requirements may be found at www.ada.gov.
