St. Albans Man Admits Gun Possession While Using Drugs

Burlington, VT – The Office of the United States Attorney for the District of Vermont stated that Michael N. Cruz, age 23, of St. Albans, pleaded guilty today to possessing a semi-automatic Glock pistol while using drugs. Cruz entered his plea before U.S. District Court Judge J. Garvan Murtha in federal court in Brattleboro.

According to facts presented in the case, Cruz was arrested by the Vermont State Police on October 17, 2011, after a motorist reported seeing him waving a pistol while driving his Audi erratically on Interstate 89. Cruz was under the influence of cocaine and marijuana when stopped, and had two loaded pistols in the car – the Glock and a Taurus – along with marijuana and over $2,000 in cash. In his plea agreement, Cruz agreed that his fine would include over $8,500 in cash seized from him in early 2012, when the U.S. Bureau of Alcohol, Tobacco & Firearms executed a federal search warrant at his apartment.

Judge Murtha scheduled sentencing for May 22, 2013. Cruz is detained in the custody of the U.S. Marshals Service. The case was investigated by the Vermont State Police, and ATF. Cruz is represented by Federal Public Defender Michael Desautels. The United States is represented by Assistant U.S. Attorney William Darrow.
