Deported Alien Indicted for Illegal Reentry

ELKINS, WEST VIRGINIA — A 27 year old deported alien was named in an Indictment returned on February 18, 2009, by a Federal Grand Jury sitting in Elkins, West Virginia.

United States Attorney Sharon L. Potter announced that JESUS ARREGUIN-RUBIO was named in a one-count Indictment charging him with entering the United States, after having been previously deported, without obtaining the express consent of the Secretary of Homeland Security or the Attorney General of the United States to reapply for admission to the United States. ARREGUIN-RUBIO was found in Jefferson County, West Virginia, on February 3, 2009.

If convicted, ARREGUIN-RUBIO faces a maximum penalty of 20 years imprisonment and a fine of $250,000.

The case will be prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by Immigration and Customs Enforcement.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
