Mexican Citizen Indicted for
Unlawfully Entering the United States
CLARKSBURG, WEST VIRGINIA — A Mexican citizen was named in an Indictment returned on March 3, 2009, by a Federal Grand Jury sitting in Clarksburg, West Virginia.
United States Attorney Sharon L. Potter announced that ARTURO VARGAS GARCIA, age 40, was named in a one-count Indictment. Count One of the Indictment alleges that GARCIA unlawfully entered the United States without having obtained the express consent of the Secretary of Homeland Security to reapply for admission to the United States. GARCIA was previously removed from the United States on September 1, 1999, near Calexico, California, and was found in Charles Town, West Virginia, on February 12, 2009.
If convicted, GARCIA faces a maximum penalty of 20 years imprisonment and a fine of $250,000.
The case will be prosecuted by Assistant United States Attorney Erin K. Reisenweber. The case was investigated by the United States Immigration and Customs Enforcement.
It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
