Linn Resident Sentenced for
Embezzling Social Security Payments

CLARKSBURG, WEST VIRGINIA — A 51 year old Linn, West Virginia, resident was sentenced today (February 8, 2010) in United States District Court in Clarksburg by Judge Irene M. Keeley.

Acting United States Attorney Betsy C. Jividen announced that BRIAN KEITH POWERS was sentenced to five years probation and ordered to pay a fine of $1,000.00 and restitution of $18,037.09. POWERS entered a plea of guilty on November 2, 2009, to a one-count Indictment charging him with embezzling $18,037.09 of Social Security payments to which he was not entitled from a bank account of a deceased individual for which he was a joint account holder from January 11, 2005, to January 24, 2007.

The case was prosecuted by Assistant United States Attorney Shawn Angus Morgan. The case was investigated by the Social Security Administration – Office of Inspector General and the United States Secret Service.
