Morgantown Resident Sentenced on
Tax Evasion and Mail Fraud Charges

CLARKSBURG, WEST VIRGINIA - A 49 year old Morgantown, West Virginia, resident was sentenced on July 15, 2011, in United States District Court in Clarksburg by Judge Irene M. Keeley.

United States Attorney William J. Ihlenfeld, II, announced that JAMES HOWARD FAIRLEY was sentenced to 24 months imprisonment to be followed by three years of supervised release. FAIRLEY entered as plea of guilty on March 30, 2011, to one count of tax evasion for the 2008 tax year and one count of mail fraud. As part of FAIRLEY’s duties as CFO of Mountain Communications and Telefax, Inc. in Hazelton, West Virginia, FAIRLEY used his access to the checks for these companies and made numerous checks for both companies payable to his creditors. As part of his agreement, FAIRLEY was ordered to make restitution in the amount of $704,979.04 to the companies and $181,234.00 to the Internal Revenue Service.

FAIRLEY, who is currently free on bond, will self-report to the designated federal institution.

The case was prosecuted by Assistant United States Attorney Robert H. McWilliams, Jr. and was investigated by the Internal Revenue Service - Criminal Investigation Division.
