Kearneysville Resident Entered Guilty Plea to Firearm Charge

MARTINSBURG, WEST VIRGINIA — A 26 year old citizen and national of Mexico, who was residing in Kearneysville, West Virginia, resident entered a plea of guilty on May 16, 2011, in United States District Court in Martinsburg before Magistrate Judge David J. Joel.

United States Attorney William J. Ihlenfeld, II, announced that GILBERTO ALVAREZ-CERVANTES, an illegal alien, entered a plea of guilty to one count of an Indictment charging him with unlawfully possessing a firearm on July 29, 2010, in Jefferson County.

ALVAREZ-CERVANTES, who is in custody, faces a maximum penalty of 10 years imprisonment and a fine of $250,000.

The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber. The case was investigated by the Department of Homeland Security – Immigration and Customs Enforcement and the Bureau of Alcohol, Tobacco, Firearms & Explosives.
