Mexican National Sentenced in Federal Court
MARTINSBURG, WEST VIRGINIA — A 26-year old citizen and national of Mexico, who was residing in Kearneysville, West Virginia, was sentenced on October 19, 2011, in United States District Court in Martinsburg by Chief Judge John Preston Bailey.
United States Attorney William J. Ihlenfeld, II announced that: GILBERTO ALVAREZ-CERVANTES, was sentenced to 12 months and 1 day imprisonment, to be followed by two years of supervised release. ALVAREZ-CERVANTES, entered a plea of guilty on May 16, 2011, to one count of an Indictment charging him with being an unlawful alien in possession of a firearm, more particularly a sawed-off shotgun, on July 29, 2010, in Jefferson County. As part of his sentence, ALVAREZ-CERVANTES agreed to the forfeiture of the firearm. The sentence imposed by Judge Bailey will run consecutively to the Federal sentence ALVAREZ-CERVANTES is presently serving out of the Middle District of Florida for his involvement in a conspiracy to distribute methamphetamine. ALVAREZ-CERVANTES was remanded to the custody of the United States Marshal.
The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the Department of Homeland Security – Immigration and Customs Enforcement, the Bureau of Alcohol, Tobacco, Firearms & Explosives, the Drug Enforcement Administration and the Jefferson County Sheriff’s Department.
