California Resident Enters Plea on Firearms Charge

WHEELING, WEST VIRGINIA - A 28 year old San Diego, California, resident entered a plea of guilty on January 11, 2012, in United States District Court in Wheeling before Judge Frederick P. Stamp, Jr.

United States Attorney William J. Ihlenfeld, II, announced that CESAR E. GARCIA entered a plea of guilty to one count of being a felon in possession of a firearm. GARCIA, having previously been convicted of Second Degree Burlary in 2004 and transportation of a controlled substance in 2009, in the Superior Court of California, County of San Diego, knowingly possessed a Winchester Model 24 20 gauge shotgun on January 15, 2011, in Glen Dale, West Virginia. GARCIA also agreed to the forfeiture of the Winchester shotgun. GARCIA, who is in custody pending sentencing, faces a maximum exposure of 10 years imprisonment and a fine of $250,000.

The case was prosecuted by Assistant United States Attorney Robert H. McWilliams, Jr. and was investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives.
