HUNTINGTON MAN SENTENCED TO 15 YEARS IN PRISON

HUNTINGTON, W.Va. – A Huntington man was sentenced today to 188 months in prison for possession with intent to distribute five or more grams of cocaine base. Daniel K. Leggette, 34, previously pleaded guilty in January. The conviction stems from a joint investigation conducted by the Huntington Police Department, Huntington Drug and Violent Crime Task Force, and the River Cities Gun Crimes Task Force. On May 14, 2008, while attempting to execute a state warrant for Leggette's arrest, agents located a plastic bag containing 7.54 grams of crack cocaine which was individually wrapped in four smaller baggies. Agents observed Leggette throw the bag of drugs to the ground as he attempted to flee the residence upon his arrest.

According to the plea agreement, Leggette stipulated that he intended to sell the crack cocaine. He further agreed that the digital scales and a loaded 9mm pistol found in his vehicle belonged to him. Because of Leggette's two prior felony convictions for possession with intent to deliver cocaine and for unlawful wounding, the Court sentenced Leggette as a career offender.

United States District Judge Robert C. Chambers presided over the proceedings. Assistant United States Attorney Lisa G. Johnston handled the prosecution.
